Welcome to Musical SEO. These Terms of Service ("Terms") govern your access to and use of the Musical SEO website and services at musicalseo.com. Please read them carefully before using our platform.
1. Acceptance of Terms
By accessing or using Musical SEO, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services. We reserve the right to update these Terms at any time, and your continued use of the service constitutes acceptance of any changes.
2. Description of Service
Musical SEO is a music niche research and keyword intelligence platform. Our service provides:
- Keyword research with search volume, CPC, and competition data
- Cross-platform analytics from Spotify, YouTube, and iTunes
- AI-powered niche analysis and content strategy recommendations
- Trend tracking and data visualization tools
- CSV and data export capabilities
Features and availability may change as we improve the platform. Free features (Spotify, YouTube, and iTunes analytics) are available to all registered users. Pro features (keyword intelligence, AI strategy) require an active paid subscription.
3. User Accounts
To use Musical SEO, you must create an account using a valid email address or through Google OAuth. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Providing accurate and up-to-date information
- Notifying us immediately of any unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
4. Subscription & Billing
Paid subscriptions are billed through Stripe, our payment processor. By subscribing, you agree to:
- Monthly plan: $19.99/month, billed monthly
- Yearly plan: $99/year, billed annually
Auto-Renewal: All subscriptions automatically renew at the end of each billing cycle (monthly or annually) at the then-current rate. You will be charged automatically using the payment method on file unless you cancel before the renewal date. You may cancel your subscription at any time from your account settings or by contacting us at support@musicalseo.com. Cancellation takes effect at the end of your current billing period — you will retain access until then.
Refund Policy: We do not offer refunds for partial billing periods. If you cancel mid-cycle, you will continue to have access until the end of the current billing period but will not receive a prorated refund. Refunds may be issued at our sole discretion for exceptional circumstances. Refunds required by applicable law will be honored.
Free Trial: Musical SEO does not currently offer a free trial. Free features (Spotify, YouTube, and iTunes analytics) are available to all registered users without a subscription.
Stripe handles all payment processing; we do not store your full payment card details.
5. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose
- Attempt to reverse-engineer, decompile, or disassemble the platform
- Scrape, crawl, or use automated tools to extract data beyond normal use
- Resell, redistribute, or commercially exploit data obtained from the service without permission
- Interfere with or disrupt the service or its infrastructure
- Share your account credentials or allow unauthorized access
- Upload or transmit viruses, malware, or other harmful code
- Circumvent rate limits or abuse the API in any manner
- Use automated access methods beyond normal browser-based use of the platform
5a. API Usage Terms
Musical SEO provides data through internal APIs that power the platform. You agree not to access these APIs outside of the normal use of the platform, attempt to circumvent rate limits, or use any method to extract data at a rate or volume exceeding what the platform interface allows. Abuse of API endpoints may result in immediate suspension or termination of your account.
6. Intellectual Property
All content, design, code, trademarks, and branding associated with Musical SEO are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, or distribute any part of our platform without express written permission.
Data you input (search queries, etc.) remains yours. However, we may use anonymized and aggregated usage data to improve our services.
7. Limitation of Liability
Musical SEO is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law:
- We do not guarantee the accuracy, completeness, or reliability of any data or analysis provided
- We are not liable for any business decisions made based on our data
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not liable for indirect, incidental, special, consequential, or punitive damages
Third-party data (from Spotify, YouTube, iTunes, Keywords Everywhere, Google) is provided as-is and may be subject to their own terms and limitations.
8. Account Termination
By Us: We may suspend or terminate your access to the service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
By You: You may terminate your account at any time by cancelling your subscription and contacting us at support@musicalseo.com to request account deletion.
Upon termination:
- Your right to access the service ceases immediately
- We may delete your account data after 30 days
- Provisions that by nature should survive termination will remain in effect (including Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution)
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Alaska, USA, without regard to its conflict of law provisions.
9a. Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the service shall first be attempted to be resolved through informal negotiation by contacting us at support@musicalseo.com. If the dispute cannot be resolved informally within 30 days, either party may elect to resolve the dispute through binding arbitration administered under the rules of the American Arbitration Association, conducted in the State of Alaska. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction. You may also bring claims in small claims court in Anchorage, Alaska, if your claim qualifies.
10. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on our website. Your continued use of the service after changes are posted constitutes acceptance of the revised Terms.
11. Age Requirement
You must be at least 18 years of age to use Musical SEO, or have the consent and supervision of a parent or legal guardian. By using the service, you represent and warrant that you meet this requirement. We do not knowingly collect information from anyone under the age of 13 (see our Privacy Policy).
12. Modification of Service
We reserve the right to modify, suspend, or discontinue any part of the service (including features, pricing, or availability) at any time, with or without notice. For material changes to pricing, we will provide at least 30 days' notice via email or a prominent notice on the website. Your continued use of the service after such changes constitutes acceptance.
13. Indemnification
You agree to indemnify, defend, and hold harmless Musical SEO, its owners, operators, affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through the service.
14. No Warranty / AS-IS Disclaimer
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. We do not warrant that the service will be uninterrupted, timely, secure, or error-free, or that the data or results obtained will be accurate or reliable.
15. Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, epidemics, pandemics, internet or infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
16. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Musical SEO regarding your use of the service, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
